Terms & Conditions — Systems for Success: The Self-Paced Course™
1. Scope of Program
Systems for Success: The Self-Paced Course™ is a self-paced digital course, delivered via online portal. It includes:

Pre-recorded videos

Downloadable PDFs, templates, and trackers

Bonuses as outlined in Section 24

This program does not include live coaching, personalized feedback, audits, or done-for-you services.

2. Fees & Payment
The program fee is $897 USD, payable in one of the following ways:
✅ Pay-in-full: $897 USD at the time of purchase
✅ Two-payment plan: $448.50 USD each, billed monthly over 2 months
✅ 12-payment plan: $85 USD each, billed monthly over 12 months

Payment is due at checkout, and access to the course is granted only after payment is received. Checking the opt-in box at purchase constitutes agreement to these terms.

For payment plans, you agree to complete all scheduled payments in full, even if you do not finish or access the course. This is not a subscription or membership; the full fee is earned at the time of purchase. A valid credit card must remain on file for the duration of your plan.

Failure to make payments may result in suspension of access, late fees, referral to collections, and legal remedies as described elsewhere in this Agreement.


3. Refund Policy
We offer a 72-hour money-back guarantee.
To request a refund, you must email hello@lindsayherkert.com within 72 hours of purchase.
No refunds will be issued if you have downloaded any course materials or after 72 hours.

4. Company’s Right to Cancel
The Company may cancel services for reasons such as illness, family emergency, or force majeure. In such cases, you may receive a pro-rated refund or credit at the Company’s discretion.

5. Confidentiality
You agree not to share, disclose, or misuse any confidential business information, strategies, or materials provided in the course.

6. Disclaimer
The Company does not provide legal, financial, medical, or other licensed professional advice. You are responsible for seeking such services elsewhere if needed.

7. Model Release
By enrolling, you grant the Company permission to use images, screenshots, or testimonials you share for promotional purposes without compensation or prior approval.

8. No Guarantees
The Company does not guarantee specific results, including financial, business, or personal outcomes. Your results depend on your own efforts and implementation.

9. Reasonable Expectations
You acknowledge that coaching and business education are subjective services, and dissatisfaction with style, content, or results is not grounds for refund beyond Section 3.

10. Force Majeure
Neither party shall be liable for delays or failures caused by events beyond their control, including natural disasters, pandemics, or governmental actions. In such events, notice must be given within 10 days, and parties will act in good faith to resolve or terminate as needed.

11. Indemnification
You agree to indemnify and hold harmless the Company and its affiliates from any claims, damages, or losses arising from your participation in the program.

12. Limitation of Liability
The Company’s maximum liability shall not exceed the amount you paid for the course. The Company is not liable for indirect, incidental, or consequential damages.

13. Taxes
Any applicable sales tax will be collected and remitted as required by law.

14. Communication
All inquiries must be emailed to hello@lindsayherkert.com. Emails are answered during business hours (Monday–Friday, 9am–4pm CST) within 48 business hours.

15. Legal Terms
Entire Agreement: This Agreement supersedes all prior agreements.

Venue & Jurisdiction: Governed by Texas law; disputes to be resolved in Travis County, TX.

Mediation & Arbitration: Disputes unresolved through mediation will proceed to arbitration in Travis County, TX.

Severability: Invalid provisions do not affect the remainder of this Agreement.

No Waiver: Failure to enforce any provision does not waive the right to enforce it later.

Transfer: Neither party may transfer this Agreement without written consent.

Headings: For convenience only; do not affect interpretation.

Notice: Notices shall be sent by email to the addresses on file.

16. Bonuses
Your purchase includes these bonuses:

Personal Coaching Call: One 30-minute Zoom call (must be scheduled within 3 months of purchase).

Website Review: Video review (must be requested within 3 months).

Private Facebook Group: Community access for support and Q&A (subject to closure at Company’s discretion).

Bonus Lesson: On mini-session strategies, included in course materials.

Bonuses are non-transferable and must be redeemed within the specified timeframes.

17. Lifetime Access
You have “lifetime access,” defined as access for as long as the course is offered. The Company reserves the right to discontinue the course at any time, which would end access.

18. Electronic Acceptance
By checking the opt-in box at purchase, you acknowledge you have read, understood, and agree to these Terms & Conditions, which constitute a legally binding agreement.
